THE PAPERWORK/PRIVACY ACT AND YOUR APPLICATION
The Social Security Act (sections 205(c) and 702) allows us to collect the facts we ask for on this form. We use most of these facts to assign you a Social Security number or to issue you a card. You do not have to give us these facts, but without them we cannot issue you a Social Security number or a card. Without a number, you could lose Social Security benefits in the future and you might not be able to get a job.
We give out the facts on this form without your consent only in certain situations that are explained in the Federal Register. For example, we must give out this information if Federal law requires us to, if your Congressman or Senator needs the information to answer questions you ask them, or if the Justice Department needs it to investigate and prosecute violations of the Social Security Act.
We may also use the information you give us when we match records by computer. Matching programs compare our records with those of other Federal, State, or local government agencies. Many agencies may use matching programs to find or prove that a person qualifies for benefits paid by the Federal government. The law allows us to do this even if you do not agree to it. If you would like more facts about the Privacy Act, get in touch with any Social Security office.

Social security numbers must be included on your Missouri individual income tax return. Such numbers are used primarily to administer and enforce the Income Tax, Sales and Use Tax, Property Tax Relief, exchange tax information with the U.S. Internal Revenue Service, other states and Multistate Tax Commission (Chapters 32 and 143, RSMo). In addition, statutorily provided non tax uses are: (1) to provide information to the Department of Higher Education with respect to applicants for financial assistance under Chapter 173, RSMo; and (2) to offset refunds against amounts due to a state agency by a person or entity (Chapter 143, RSMo). Information furnished to other agencies or persons shall be used solely for the purpose of administering tax laws or the specific laws administered by the person having the statutory right to obtain it as indicated above. On the application, a person does not have to 'give these facts,' but if the person chooses not to 'give these facts', the person cannot be issued a social security number or a card. And if a person does not 'give these facts', then the person might not be able to get a job.
If a person does 'give these facts' and therefore does get a social security number and a social security card, then the person is informed that this social security number is his/her account and the card is property of the social security administration and must be returned upon request.
According to Black's Law Dictionary, federal legislation created the Social Security Act. The Social Security Act created the Social Security Administration which administers a national program of contributory social insurance to be put into special trust funds and cash benefits paid out to the person or family. According to F.I.C.A., this contributory social insurance is also a Social Security tax which issues a Social Security benefit from collected taxes which were placed into special trust funds.
When a person applies for a social security number and a card, this number is allegedly used to create and open an account for that person to participate in a federally created contributory social insurance plan. This insurance plan would therefore be voluntary.
In actuality, when a person applies for a social security number and a card, this number is used to administer and enforce an income tax. This tax is collected and put into special trust funds to be paid out as cash benefits issued by the federal government.

Fraud. An intentional perversion of the truth for the purpose of inducing another in reliance upon it to part with some valuable thing belonging to him or to surrender a legal right. A false representation of a matter of fact, whether by words or by conduct, by false or misleading allegations, or by concealment of that which should have been disclosed, which deceives and is intended to deceive another so that he shall act upon it to his legal injury. Anything calculated to deceive, whether by a single act or combination, or by suppression of truth, or suggestion of what is false, whether it be by direct falsehood or innuendo, by speech or silence, word of mouth, or look or gesture. A generic term, embracing all multifarious means which human ingenuity can devise, and which are resorted to by one individual to get advantage over another by false suggestions or by suppression of truth, and includes all surprise, trick, cunning, dissembling, and any unfair way by which another is cheated. "Bad faith" and "fraud" are synonymous, and also synonyms of dishonesty, infidelity, faithlessness, perfidy, unfairness, etc.
Elements of a cause of action for "fraud" include false representation of a present or past fact made by defendant, action in reliance thereupon by plaintiff, and damage resulting to plaintiff from such misrepresentation.
As distinguished from negligence, it is always positive, intentional. It comprises all acts, omissions, and concealments involving a breach of a legal or equitable duty and resulting in damage to another. And includes anything calculated to deceive, whether it be a single act or combination of circumstances, whether the suppression of truth or the suggestion of what is false, whether it be by direct falsehood or by innuendo, by speech or by silence, by word of mouth, or by look or gesture. Fraud, as applied to contracts, is the cause of an error bearing on a material part of the contract, created or continued by artifice, with design to obtain some unjust advantage to the one party, or to cause an inconvenience or loss to the other. Individual. As a noun, this term denotes a single person as distinguished from a group or class, and also, very commonly, a private or natural person as distinguished from a partnership, corporation, or association; but it is said that this restrictive signification is not necessarily inherent in the word, and that it may, in proper cases, include artificial persons. See also Person.
As an adjective, "individual" means pertaining or belonging to, or characteristic of, one single person, either in opposition to a firm, association, or corporation, or considered in his relation thereto.
Individual assets. In the law of partnerships, property belonging to a member of a partnership as his separate and private property, apart from the assets or property belonging to the firm as such or the partner's interest therein.
Individual debts. Such as are due from a member of a partnership in his private or personal capacity, as distinguished from those due from the firm or partnership.
Individual system of location. A term formerly used in some states to designate the location of public lands by surveys, in which the land called for by each warrant was separately surveyed.
Person. In general usage, a human being (i.e. natural person), though by statute term may include labor organizations, partnership, associations, corporations, legal representatives, trustees, trustees in bankruptcy, or receivers. See e.g. National Relations Act, Uniform Partnership Act.
Scope and delineation of term is necessary for determining those to whom Fourteenth Amendment of Constitution affords protection since this Amendment expressly applies to "person."
Aliens. Aliens are "persons" within the meaning of Fourteenth Amendment and are thus protected by equal protection clause against discriminatory state action.
Corporation. A corporation is a "person" within meaning of Fourteenth Amendment equal protection and due process provisions of United States Constitution. The term "persons" in statute relating to conspiracy to commit offense against United States, or to defraud United States, or any agency, includes corporation.
In corporate law, "person" includes individual and entity.
Foreign government. Foreign governments otherwise eligible to sue in U.S. courts are "persons" entitled to bring treble-damage suit for alleged antitrust violations under Clayton Act.
Illegitimate child. Illegitimate children are "persons" within the meaning of the Equal Protection Clause of the Fourteenth Amendment, and scope of wrongful death statute.
Interested person. Includes heirs, devises, children, spouses, creditors, beneficiaries and any others having a property right in or claim against a trust estate of the estate of a decedent, ward or protected person which may be affected by the proceeding. It also includes persons having priority for appointment as personal representative, and other fiduciaries representing interested persons. The meaning as it relates to particular persons may vary from time to time and must be determined according to the particular purposes of, and matter involved in, any proceeding.
Minors. Minors are "persons" under the United States Constitution, possessed of rights that government must respect.
Municipalities. Municipalities and other government units are "persons" within the meaning of 42 U.S.C.A. sec. 1983. Local government officials sued in their official capacities are "persons" for purposes of Section 1983 in those cases in which a local government would be suitable in its own name. See Color of Law.
Definition of "persons" covered by antitrust laws includes cities, whether as municipal utility operators suing as plaintiffs seeking damages for antitrust violations or as operators being sued as defendants.
Protected persons. One for whom a conservator has been appointed or other protective order has been made.
Resident alien. A resident alien is a "person" within the meaning of the due process and equal protection clauses of the Fourteenth Amendment.
Persona. Lat. In the civil law, character in virtue of which certain rights belong to a man and certain duties are imposed upon him. Thus one man may unite many characters (personae), as, for example, the characters of father and son, of master and servant.
